Terms & Conditions
Once you have chosen a travel program, please read the contents of this document, as your reservation is subject to the terms and conditions listed below. The payment of a reservation for any KALLPA PERU TRAVEL program or tour implies consent to all the provisions of the Reservation Terms and Conditions established in this document, which is binding for all tours.
General
- The travel program may change depending on weather conditions, as well as at the decision of the program participants.
- KALLPA PERU TRAVEL is not responsible for any loss or damage to the client’s personal belongings, or for any consequence caused by said loss or damage.
- We do not assume responsibility for any illness or accident that may occur. If the client falls ill or an accident occurs, the responsibility and associated costs fall on the client.
- The customer is responsible for the equipment provided by the company. The total cost for the damage or loss of said equipment must be compensated by the client upon returning to Cusco.
- The client declares that he is in good physical and mental health. KALLPA PERU TRAVEL is not responsible for any consequence, in case the client is not in good health.
Reservation Procedures (Deposit)
Please contact us before making any payment. We request a 50% deposit per person for the chosen program at the time of booking. This deposit is not refundable in case of cancellation by the client. By making the deposit, you enter into a contract with KALLPA PERU TRAVEL. We then accept and confirm the reservation. Keep in mind that the travel programs are not confirmed until KALLPA PERU TRAVEL indicates it in writing.
This 50% advance can be paid through WESTERN UNION, PAYPAL or another online payment method. Payment will be made in the name of KALLPA PERU TRAVEL staff.
KALLPA PERU TRAVEL will NOT pay bank taxes or transfer costs. All transfer costs must be paid by the client.
Final Balance Payment
- The price of the program is in US dollars. We require that you pay your final balance in our office at least 24 hours before your tour. We currently accept cash (Peruvian soles or US dollars) and Visa (they charge 8% commission).
- The program price per person is agreed at the time of booking confirmation and will not increase or decrease.
Cancellation by the client
In case of cancellation by the client, this must be notified in writing to KALLPA PERU TRAVEL. Please note that the deposit is non-refundable. Please indicate the reason for the cancellation, as this may be covered by your insurance policy.
If the cancellation notice is received 15 days before departure, the client will lose the 50% deposit. From 15 to 7 days before departure, 50% of the tour price will be refunded only if 100% is paid in advance. Less than 48 hours before departure, no money will be refunded. Neither will money be refunded in case of cancellation of only part of the tour.
Cancellation / Changes by us
Circumstances beyond our control: technical problems, weather conditions, strikes, riots and government decisions.
In such cases, KALLPA PERU TRAVEL will propose solutions to offer the service or similar travel programs, but will not refund the money. Consequently, we reserve the right to modify the scheduled itinerary. We will use reasonable efforts to provide you with the booked travel schedule, but changes may occur.
If the changes are significant, and if possible, we will inform you before the departure date. We will once again offer similar alternative travel programs. All additional expenses derived will be borne by the client. Please note that KALLPA PERU TRAVEL will not be responsible for reimbursing any additional expenses incurred by the client in preparation for the tour. This includes international tickets and fees, cost of visas, vaccinations, among others.
Cancellations caused by KALLPA PERU TRAVEL: we will refund 100% of your payment.
Risk Acceptance
Some of the KALLPA PERU TRAVEL itineraries have been designed to provide participants with exposure to the true nature of the place visited. Therefore, they involve an element of personal risk, which could result in physical or emotional injury, paralysis, death or damage to the client, their property or third parties. The client understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity, and are therefore assumed by the client as part of the tour. The client accepts that he is aware of his physical state and health and that, by virtue of this, he decides to assume the aforementioned risks. The client excludes KALLPA PERU TRAVEL from any liability linked to any accident or injury that may occur.
Authority on Tours
At all times, the decision of the guide or representative of the company will be final in all matters that may endanger the safety and well-being of the travel group. You must follow the instructions of the guide at all times.
The client must at all times strictly comply with the drug laws and regulations of Peru. If the client fails to comply with the above, or if the client interferes with the welfare of the group, the guide or company representative may order the client to leave the tour without any refund.
Travel Documents
The client must have his passport in possession. The original document or at least one copy must be carried on the tour.
Travel insurance
We strongly recommend that you take out travel insurance that covers accidents, medical expenses and emergency repatriation, including rescue and air ambulance. We also recommend that such insurance cover cancellations and lost luggage.
Thirdparty services
KALLPA PERU TRAVEL directly operates part of the services included in the travel programs, but also makes arrangements with airlines, hotels and other independent companies to provide you with all the services offered. We take all reasonable steps to ensure that such independent companies provide their services upholding our quality standards. However, these companies are independent providers over which we do not have direct or full control.
KALLPA PERU TRAVEL therefore cannot accept any responsibility for loss, damage, inconvenience, delay, etc.
Claims and Complaints
If a customer has a complaint against the company, they must first bring this to the attention of the guide during the tour so that the guide can attempt to rectify the matter. Any other complaints must be submitted in writing to the company within 7 days after the end of the tour.
Jurisdiction for all claims or disputes will be exclusively in Cusco, Peru, whose courts, using Peruvian Law, will have exclusive jurisdiction.
Claims for damages against KALLPA PERU TRAVEL will be limited to the value of the item in dispute. Any liability is limited to the total price paid for the tour. In all cases, the company is not responsible for indirect, incidental or consequential losses or expenses, including lost profits.
